By using our website or purchasing from Unearthed Wellness, you agree to these Terms. If you do not agree, please do not use our website or services.

1. About Unearthed Wellness

Unearthed Wellness is a wellness ecommerce platform that helps connect eligible customers with independent, licensed healthcare providers and third-party pharmacy partners for certain wellness products and services. Unearthed Wellness is not a medical provider, medical practice, pharmacy, or drug manufacturer.

Medical services, if applicable, are provided by independent licensed healthcare professionals through our telehealth partner. Prescription fulfillment, if applicable, is handled by licensed third-party pharmacies.

2. No Medical Advice

The content on this website is provided for general informational and educational purposes only. Nothing on this website should be interpreted as medical advice, diagnosis, or treatment.

Unearthed Wellness does not provide medical care and does not practice medicine. Any medical consultation, diagnosis, treatment plan, prescription decision, or clinical recommendation is made solely by an independent licensed healthcare provider.

Your use of this website does not create a doctor-patient relationship with Unearthed Wellness.

3. Eligibility

4. Telehealth and Prescription Services

Submission of payment, completion of intake forms, or participation in a consultation does not guarantee:

  • that you will be approved for treatment;
  • that a prescription will be written;
  • that a particular medication or product will be recommended;
  • that a pharmacy will fill any prescription; or
  • that treatment is appropriate for you.

All prescribing decisions are made at the sole discretion of the licensed medical provider.

5. Pharmacy Fulfillment

If a provider prescribes treatment, that prescription may be fulfilled by an independent third-party pharmacy, subject to pharmacy review, availability, and applicable law.

Unearthed Wellness does not compound, manufacture, dispense, store, test, or ship prescription medications unless explicitly stated otherwise. We do not control pharmacy operations, shipping carriers, or inventory availability, and we are not responsible for pharmacy delays, shortages, fulfillment errors, or shipping disruptions caused by third parties.

6. Product and Treatment Disclosures

Wellness products and prescription therapies may involve risks, side effects, contraindications, and varying outcomes. Results are not guaranteed, and individual responses may differ.

You are responsible for truthfully and fully disclosing your health history, medications, allergies, and other relevant information during intake and throughout treatment. Inaccurate or incomplete information may affect your eligibility, safety, and treatment outcome.

You should promptly seek medical attention or contact a qualified healthcare professional if you experience side effects, worsening symptoms, or a medical emergency.

7. Subscriptions, Billing, and Payments

Certain services or offerings may be provided through a subscription or recurring billing model. By enrolling in a subscription, you authorize Unearthed Wellness to charge your payment method on a recurring basis in accordance with the terms presented to you at checkout.

You agree that:

  • all billing information provided is accurate and authorized;
  • recurring charges may continue until canceled in accordance with the applicable cancellation terms;
  • you are responsible for reviewing the details of your subscription before purchase; and
  • failure to cancel before renewal may result in continued charges.

We reserve the right to correct pricing errors, refuse orders, or cancel transactions where necessary.

8. Refunds and Cancellations

Because many of our services involve administrative processing, telehealth coordination, pharmacy fulfillment, and other third-party costs, refunds may be limited or unavailable once services have begun.

Unless otherwise stated at the time of purchase:

  • consultation fees may be non-refundable once scheduled or completed;
  • prescription products may be non-refundable once prescribed, processed, compounded, shipped, or delivered, except where required by law;
  • subscription charges are non-refundable for the billing period in which they are charged unless otherwise stated.

Cancellation requests must be made in accordance with the cancellation process provided on the website or in your account. Chargebacks or payment disputes submitted without first contacting customer support may result in suspension or termination of your account.

9. Account Responsibility

If you create an account, you are responsible for maintaining the confidentiality of your login information and for all activity under your account.

You agree to notify us promptly of any unauthorized access, suspected breach, or misuse of your account. We reserve the right to suspend or terminate accounts that appear fraudulent, misleading, unlawful, or in violation of these Terms.

By using our services, you acknowledge that your information may be shared with healthcare providers, pharmacies, service providers, and technology vendors as necessary to operate the services and fulfill your requests.

All website content, including text, graphics, branding, logos, images, layout, design, and other materials, is owned by or licensed to Unearthed Wellness and is protected by applicable intellectual property laws.

15. Limitation of Liability

To the fullest extent permitted by law, Unearthed Wellness and its officers, directors, employees, contractors, affiliates, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the website, services, telehealth consultations, prescriptions, pharmacy fulfillment, shipping delays, product availability, or treatment outcomes.

To the fullest extent permitted by law, Unearthed Wellness is not responsible for:

  • medical decisions or treatment recommendations made by healthcare providers;
  • prescriptions written or not written by providers;
  • pharmacy fulfillment decisions, delays, or errors;
  • side effects, adverse reactions, or treatment complications; or
  • losses resulting from inaccurate information provided by you.

If liability is found notwithstanding the above, Unearthed Wellness’s total liability shall not exceed the amount you paid to Unearthed Wellness for the specific service or product giving rise to the claim in the 3 months preceding the event.

16. Indemnification

You agree to defend, indemnify, and hold harmless Unearthed Wellness and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your use of the website or services;
  • your violation of these Terms;
  • your violation of any law or regulation;
  • your misuse of any treatment, product, or prescription; or
  • any false, inaccurate, or incomplete information you submit.
